First draft of the EU’s nine-page negotiating guidelines

European Council President Donald Tusk has released a first draft of the EU’s nine-page negotiating guidelines for the 27 remaining EU member states, within 48 hours from the time the UK triggered Article 50 of the Lisbon Treaty.

The EU negotiation draft guidelines have proposed that Spain have a veto on any Brexit agreement applying to Gibraltar. "After the United Kingdom leaves the Union, no agreement between the EU and the UK may apply to the territory of Gibraltar without the agreement between the kingdom of Spain and the UK."

The document also states: "In these negotiations the Union will act as one. It will be constructive throughout and will strive to find an agreement. This is in the best interest of both sides."

“The Union will work hard to achieve that outcome, but it will prepare itself to be able to handle the situation also if the negotiations were to fail.”

The draft guidelines also make clear that the EU is willing to consider a “transitional” arrangement after the initial two year period.
